Terms of Use

1. Introduction

Welcome to SingThem. SingThem (hereinafter, "the Service") is a platform that generates personalized songs using artificial intelligence. Your account, credits and songs are the same across all SingThem modes (CookThem, WooThem, HypeThem, PrankThem, ThankThem and CelebrateThem).

These Terms constitute a legally binding agreement between you ("User") and SingThem. If you do not agree to these Terms, do not use the Service.

2. Your account

To access certain features (unlimited creation, song management, subscriptions) you must create an account by providing a valid email and, optionally, authenticating via Google or Apple.

You are responsible for the accuracy of the data you provide, the confidentiality of your password and any activity under your account. Notify us immediately of any unauthorized use.

You may only have one personal account. Any attempt to circumvent free-plan limits via multiple accounts or devices may result in suspension of the Service.

3. Service description

SingThem generates lyrics and music from the data you provide (recipient description, tone, music style). The result is a unique song, generated by AI models in minutes.

The free plan allows the creation of one anonymous song per device. Paid plans (packs and subscriptions) offer larger monthly quota or one-time bundles.

We reserve the right to modify, suspend or discontinue features of the Service at any time. If a modification substantially affects a paid plan, subscribers will be entitled to a proportional refund.

4. User content

When using the Service you provide information about the person the song is dedicated to and, where applicable, public social media profiles (Instagram, LinkedIn, YouTube). You are responsible for having the legitimate right to use such data: either your own use, the holder's authorization, or because it is public information.

It is forbidden to provide special category data (racial origin, health, sexual orientation, political opinions) or content that violates third-party rights (harassment, defamation, discrimination, sexually explicit material or material affecting minors).

SingThem may review generated content to ensure compliance with these Terms. Songs that infringe the rules may be removed without notice, and the responsible account may be suspended or closed.

5. Intellectual property

SingThem owns the Service: the brand, the app design, the code and the infrastructure. These elements are protected by intellectual property laws and may not be copied, modified or redistributed without express permission.

Generated content (lyrics and audio) is licensed to you under a personal, non-exclusive, non-commercial license. You may share, download and use it on your social media for non-commercial purposes, provided you respect these Terms.

For commercial use (including advertising or products for sale) write to hello@cookthem.com to agree on a specific license.

You retain ownership of the data you contribute (descriptions, photos), and grant us a limited license to process them solely to generate your song.

6. Paid plans and subscriptions

We offer one-time song packs and monthly or annual subscriptions (Bronze, Silver, Gold) with recurring fees.

Prices are shown in the app before purchase and may vary by country. Final invoicing is in EUR (web) or in the local currency applied by your store on mobile.

Subscriptions automatically renew at the end of each period unless you cancel beforehand. Cancellation is effective at the end of the current period; you keep access until that date.

To manage subscriptions: on the web from "My Profile"; on iOS from Settings > Apple ID > Subscriptions; on Android from Google Play > Subscriptions.

7. Refunds

The 14-day right of withdrawal under European consumer law does not apply to digital content generated on demand once delivery has begun — and by clicking "Buy" you acknowledge this point.

Notwithstanding, we will handle each case individually. If you believe your purchase deserves a refund (song not generated due to a technical error, Service failure), write to support@cookthem.com within 14 days of purchase.

For purchases made on the App Store or Google Play, refunds are handled directly by Apple and Google according to their own policies.

8. User conduct

You agree not to:

Use the Service to create illegal, defamatory, discriminatory, harassing, sexually explicit content, or content affecting minors.

Impersonate another person or deceive about your relationship with the song's recipient.

Circumvent security measures or attempt to access non-public parts of the Service.

Reverse-engineer or attempt to extract prompts, models, or training data.

Use the Service via bots, automated scraping, or unofficial APIs.

Resell generated content without an appropriate license.

Any breach may result in immediate account suspension without refund.

9. Warranties and exclusions

The Service is provided "as is". We do not guarantee that generated content will be perfect, error-free, or meet all your creative expectations. AI may produce unexpected results.

We are not responsible for the consequences of using the content on social media or any other social interaction. If your joke does not land, that is not our problem.

We do not guarantee uninterrupted availability of the Service. Outages may occur due to maintenance or technical failures.

10. Limitation of liability

To the maximum extent permitted by law, SingThem will not be liable for indirect, incidental or consequential damages (lost profits, data loss, reputational harm) arising from use of the Service.

SingThem's aggregate liability under any circumstance shall not exceed the amount paid by the User in the 12 months preceding the event giving rise to liability.

This limitation does not affect mandatory consumer rights granted by Spanish and European law.

11. Termination

You may close your account at any time from the "My Profile" > "Delete account" section. Deletion is immediate.

SingThem may suspend or close your account without notice in case of a serious breach of these Terms. In such case, you will lose access to the Service and, if you had unspent song credits, they will not be refunded except in the case of error on our part.

Clauses that by their nature must survive termination (intellectual property, limitation of liability, governing law) shall remain in force.

12. Changes to these Terms

We may update these Terms when necessary. When changes are substantial, we will notify in-app and/or via email to registered users 30 days in advance.

Continued use of the Service after the new version takes effect implies acceptance. If you do not agree, you must stop using the Service and, if you wish, delete your account.

13. Governing law and jurisdiction

These Terms are governed by Spanish law.

Disputes arising in connection with the Service shall be submitted to the competent courts of the consumer's domicile (where applicable). Otherwise, to the courts of Madrid (Spain).
